Terms and Conditions


1. Scope

The following terms and conditions (“General Terms and Conditions”) apply to all bookings made via eHotel AG (www.ehotel.at, www.ehotel.ch, www.ehotelag.com, www.ehotel.de and more). They regulate the contractual relationship between the customer and eHotel AG as an intermediary of travel services and the respective providers of the booked service (e.g. the hotels, below: service providers). Once a booking has been completed and a contract is created, it is the responsibility of the service provider to provide the service that has been booked and it is the customer’s responsibility to pay in full for this service. For all bookings, eHotel AG acts as the agent of the client, which is the travel provider.

2. Bookings

Bookings are passed on by eHotel AG to the service provider. eHotel AG only acts as a messenger of explanation. Contracts for the booked service are concluded exclusively between the customer and the service provider and are subject to the respective terms and conditions of the service provider. The general terms and conditions for brokering travel services are recognized by the customer’s booking. He has the opportunity to find out more about relevant questions about the contract about the information provided by eHotel AG.

3. Traveler name and email address

It is very important that the customer indicates the names of all travelers correctly and completely. Initials or abbreviations of names may result in the hotel not accepting the guest. Therefore, we ask you to write out all names, starting with the first name followed by the last name. It is the customer’s responsibility to ensure that he has entered the correct email address. Since all e-mail messages can be checked via the website in the “My Account” area, eHotel AG assumes no responsibility for messages that have not been read by the customer.

4. Prices

The prices are per room and night. Some of the offers include breakfast, some of which is not included. In addition to the overnight service, other services such as breakfast, internet or parking can be included. The scope of services is regulated in the individual booking conditions of the service provider. The prices do not include fees for optional additional costs (such as minibar snacks or telephone calls). Prices can be displayed in different currencies. The prices displayed are subject to currency fluctuations. There may be slight deviations in the published prices on a daily basis. eHotel AG is not liable for exchange rates or bank charges.

5. Booking, cancellation and payment terms

The booking, cancellation and payment terms depend on the respective offer. These are described in detail before booking and can be found in the individual offers. Group bookings and bookings for certain periods of time such as trade fairs or other major events are subject to special booking and cancellation conditions. The hotels are often subject to severe restrictions on cancellation and residence conditions.

6. Payment

The payment of the mediated services is made exclusively to the service provider, unless regulated separately below. Depending on the booked offer, payment is made at the time of booking, in whole or in part, or in the hotel upon arrival or departure. Any separate booking, rebooking or cancellation fee in favor of eHotel does not apply to the customer. The amount to be paid to the service provider can increase by certain fees (e.g. taxes and service fees, tourist taxes) in individual cases.

7. Rebookings and Cancellations

Cancellations and rebookings can be made in writing by e-mail or fax or by telephone in accordance with the conditions of the service provider online or at the service center of eHotel AG. Changes are subject to availability. Changing the travel dates can lead to changed prices. eHotel AG points out that cancellation fees of up to 100% of the travel price can be charged by the hotel/service provider. The regulations are noted in the booking conditions of the individual bookings and the terms and conditions of the respective service provider.

8. Room types and special requests

The customer has to ensure that the booked room type is suitable for the traveler. The type of room indicated at the time of booking is passed on by eHotel AG to the service provider. However, it may happen that the hotel offers 2 single beds instead of a double bed or vice versa 2 single beds instead of a double bed. Although requests regarding room types and preferences such as non-smoking/smoking rooms are forwarded to the hotel, the hotel room is allocated and subject to availability at the time of arrival.

9. Hotel information and facilities

Hotel information: Although eHotel AG strives to reproduce all hotel information as accurately as possible, we are not responsible for the accuracy of this information or for the facilities that may be available during your hotel stay or who did not meet your tastes and preferences. Renovations/renovation and maintenance are necessary for the maintenance of the hotels and can take place without warning. However, the hotelier or service provider must try to keep inconvenience at a minimum level. Signs of normal wear and tear are expected in a hotel and are out of our control. eHotel AG is not responsible for any disruptions or inconveniences to the customer, which are beyond its control, as well as for accidents or losses in a hotel caused by the staff or hotel management. Hotel and room photos should give the customer a general overview of the hotel. Room photos may come from a room category other than the one booked and do not have to represent the room actually allocated.

10. Card Information

The cards are provided for informational purposes only. eHotel AG endeavors to reproduce hotel information and cards as accurately as possible, the responsibility for the accuracy of the information or for errors/omissions cannot be assumed. Up-to-date and complete information about the location and directions must be obtained directly from the hotel.

11. Additional hotel fees

Hotels can charge additional fees for various services and services, such as air conditioning, safe, mini-bar, TV remote control, luggage storage, sauna, spa and swimming pool use, parking fees etc. to pay. eHotel AG cannot be held liable for unforeseen fees of the hotel.

12. Tourist Tax, City Taxes, Tourist Taxes, Local Taxes, Residence Taxes and Ressort Fees

Some municipalities have different strategies in terms of taxes, whether city, tourist or local taxes. Our prices always include the vulnerable hotel taxes other than tourist taxes or local taxes, which usually include the use of local services, which in this case must be paid directly to the hotel. All valid city, tourist or other taxes will be accepted by the hotel at the time of departure.

13. Minors

eHotel AG does not accept bookings from minors. The booker must be 18 years or older to be able to act. For travel bookings to the USA, the booker must be at least 21 years old. All hotels require at least one guest to be of legal age. In some US states, the age limit is higher.

14. General

The service of eHotel AG is only intended for legitimate bookings. Anyone who uses a credit card or alternative payment method without authorization is liable to prosecution. We reserve the right to cancel any booking that is considered non-legitimate.

15. Order completion, liability

The acceptance of the mediation order by eHotel AG is made by the booking confirmation. The customer is liable to the service provider for the fulfillment of the obligation under the contract arranged by eHotel AG. eHotel AG is not liable for any performance obligations from the brokered contract nor for a brokerage success. eHotel AG is not obliged to check the information provided by the service provider and is not liable for the correctness of this information, provided that eHotel AG does not transmit this data in a grossly negligent, intentionally incorrect manner or transmits it despite serious concerns about its correctness. In particular, statements by the service provider about the quality of the respective hotel (location, equipment, etc.) are not within the area of liability of eHotel AG.

eHotel AG is not obliged to provide information or information about passport, visa, customs or health regulations in connection with its brokerage activities. Otherwise, eHotel AG is only liable to all books to the extent for damages incurred for damage incurred in connection with its brokerage activities, for whatever legal reason if:

(1) Damage caused by an intentional or grossly negligent breach of a contractual obligation caused by eHotel AG, its legal representatives and/or vicarious agents.

(2) eHotel AG has separately assured a specific property of the contractual service before or upon conclusion of the contract and this property is not available after the contractual services have been rendered.

(3) the damage was caused by intentional breach of a main contract obligation, i.e. a contractual obligation so important for the Bucher that he would not have concluded the contract without being able to trust in the fulfillment of this contractual obligation.

Insofar as eHotel AG is liable for grossly negligent actions or omissions after (1) and with regard to all liability in accordance with (2) and (3) the liability is limited to the amount of the price of the service provided.

16. Privacy

eHotel AG is entitled to electronically store the personal data transmitted by the customer. eHotel AG undertakes to only use the data transmitted by the customer for its own purposes and not to pass it on to outside third parties. EHOTEL AG also uses the stored information to notify of special offers, new releases and other promotions. The customer can at any time decide not to receive this information any further by objecting to the corresponding use of the data to eHotel AG.

17. Jurisdiction

Insofar as the agreement of a place of jurisdiction between the customer and eHotel AG is permitted, the place of jurisdiction for all disputes arising from the Berlin service is. German law applies to the brokerage service.
